Welcome to Lazy Surf Report. These Terms & Conditions (“Terms”) govern your use of our website, services, communications, and products (collectively, the “Service”). By using the Service, you agree to these Terms. If you don’t agree, please do not use the Service.

1. About Us

Lazy Surf Report is a surf forecasting and reporting service operated by LAZY SURF REPORT (Pty) Ltd. (“we”, “us”, “our”). We provide surf condition updates, including via website and messaging services (e.g. WhatsApp), to help users understand surf conditions. But we are not a professional surf guide, coach, or safety authority.

2. User Eligibility

You must be at least 16 years old to use this Service. Using our Service if you are under 16 is not permitted. If you are under 16, you may use the Service only with consent from a parent or guardian.

3. Service Description & Use

• We offer surf report updates, alerts, and optional promotional/educational content.
• You may receive messages via WhatsApp only if you opt in. Your use of WhatsApp is subject to WhatsApp's terms of service.
• You are responsible for providing accurate contact information.
• We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.
• We do not guarantee uninterrupted or error-free service. Scheduled maintenance may occur.

3A. Account Security & Sharing

• You are responsible for maintaining the confidentiality of your account credentials.
• Account sharing is prohibited. Each subscription is for individual use only.
• You are responsible for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

4. Disclaimers & Limitation of Liability

IMPORTANT SAFETY WARNING: Surfing and ocean activities carry inherent risks including drowning, injury, and death. Our forecasts are informational only and should never be your sole source of safety information.

• "AS IS" Service: The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
• No Accuracy Guarantee: Surf forecasts are based on third-party data sources and predictive models. Conditions are unpredictable and may be inaccurate. Always verify conditions locally and use your own judgment.
• No Liability: To the fullest extent permitted by law, we are not responsible for any loss, injury, death, claim, cost, or damage of any kind resulting from your use of the Service, reliance on surf reports, or ocean activities.
• Third-Party Data: We aggregate data from third-party sources. We are not responsible for the accuracy or availability of third-party data.
• Maximum Liability: Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months prior to the claim.

5. Payments & Subscriptions

• Fees: You agree to pay all applicable fees for your selected subscription tier.
• Payment Processor: Payments are processed securely through Polar. You agree to Polar's terms and conditions.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
• Price Changes: We may change subscription fees with 30 days' notice. You'll have the opportunity to cancel before the new price takes effect.
• Failed Payments: If payment fails, we may suspend or terminate your access until payment is resolved.
• Taxes: All fees are exclusive of applicable taxes, which you are responsible for paying.
• Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

Refund Policy

We offer a 14-day refund policy for all subscriptions and purchases. If you are not satisfied with our service, you may request a full refund within 14 days of your initial purchase or subscription renewal. To request a refund, please contact us at support@lazy-surf-report.com. Refunds will be processed within 3-5 business days for card payments and within 48 hours for PayPal payments. This refund policy is in accordance with Polar's Buyer Terms and applicable consumer protection laws. After cancellation, you retain access until the end of your paid period.

6. Intellectual Property

Our Content

• All content, design, graphics, code, data, text, images, forecasts, trademarks, and logos are our property or licensed to us.
• You may not copy, reproduce, modify, republish, upload, post, transmit, distribute, or create derivative works from our content except as expressly permitted.
• You may view and use the Service for personal, non-commercial purposes only.

User-Generated Content

• You retain ownership of content you submit (e.g., surf session logs, photos).
• By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content in connection with the Service.
• You represent that you own or have rights to any content you submit and that it doesn't infringe third-party rights.

7. User Conduct

You agree not to:

• Use the Service for unlawful purposes or in violation of any applicable laws.
• Interfere with, disrupt, or impose unreasonable load on the Service or servers.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or systems.
• Upload or transmit viruses, malware, or any harmful code.
• Upload or transmit content that infringes others' intellectual property or privacy rights.
• Scrape, crawl, or use automated tools to access the Service without permission.
• Resell, redistribute, or commercialize the Service or its content.
• Impersonate others or misrepresent your affiliation with any person or entity.

8. Privacy

Our Privacy Policy (posted at this link) explains how we collect, use, share, and protect your personal data. By using the Service, you consent to the Processing described in the Privacy Policy.

9. Termination

• We may suspend or terminate your access to the Service at any time, for any reason, including breach of these Terms, with or without notice.
• You may terminate your account at any time by cancelling your subscription and deleting your account.
• Upon termination, your rights under these Terms end immediately.
• Sections that by their nature should survive termination (liability disclaimers, intellectual property, indemnification, governing law) remain in effect.
• We may delete your data after account termination in accordance with our Privacy Policy.

9A. Indemnification

You agree to indemnify, defend, and hold harmless LAZY SURF REPORT (Pty) Ltd., its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit.

10. Changes to Terms

We may modify these Terms from time to time. When we do, we will update the “Last updated” date. If changes are material, we’ll attempt to notify users (e.g. via email or inside the Service).

11. Governing Law & Dispute Resolution

• Governing Law: These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles.
• Jurisdiction: Any dispute arising from or related to these Terms or the Service shall be resolved in the courts of Cape Town, South Africa.
• Severability: If any provision is found invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining Terms will remain in full effect.

11A. Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
